PLEASE READ THESE TERMS OF SERVICE CAREFULLY BEFORE USING THIS WEBSITE. BY ACCESSING OR USING THE WEBSITE, YOU AGREE TO BE BOUND BY THESE TERMS.

1. Agreement to Terms

These Website Terms of Service "(Terms)" constitute a legally binding agreement between you "(you", "your", or "User") and CMBM HOLDINGS PTY LTD (ABN 29 692 775 189), a company incorporated in Victoria, Australia "(CMBM Holdings", "we", "us", or "our"), governing your access to and use of the website located at www.combatmirror.com (the "Website").

If you do not agree to these Terms, you must not access or use the Website.

Note: If you are a participant in the Combat Mirror™ closed beta testing program, your use of the mobile or web application is governed by a separate set of Application Terms of Service (Closed Beta).

2. Use of the Website

2.1 Permitted Use

You may use the Website for lawful purposes only and in accordance with these Terms. You agree not to use the Website:

  • In any way that violates any applicable federal, state, local, or international law or regulation.
  • To engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Website.
  • To impersonate or attempt to impersonate CMBM Holdings, a CMBM Holdings employee, another user, or any other person or entity.

2.2 Prohibited Conduct

You agree not to:

  • Use any robot, spider, or other automatic device, process, or means to access the Website for any purpose, including monitoring or copying any of the material on the Website.

2.3 Right to Suspend or Block Access

We reserve the right, in our sole discretion, to suspend, block, or terminate your access to all or part of the Website for any or no reason, including without limitation, any violation of these Terms.

The Website and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by CMBM Holdings, its related entities (including PROTECTYOURSELFATALLTIMES PTY. LTD), its licensors, or other providers of such material and are protected by Australian and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Website without our prior written consent.

If the Website contains links to other sites and resources provided by third parties, these links are provided for your convenience only. We have no control over the contents of those sites or resources, and accept no responsibility for them or for any loss or damage that may arise from your use of them. 6. Limitation of Liability

6.1 Australian Consumer Law Savings Clause

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you by the Competition and Consumer Act 2010 (Cth), the Australian Consumer Law, or any other applicable law that cannot be excluded, restricted, or modified by agreement.

6.2 Limitation

To the fullest extent provided by law, and subject to Section 6.1, in no event will CMBM Holdings, its related entities, or their licensors, service providers, employees, agents, officers, or directors be liable for damages of any kind, under any legal theory, arising out of or in connection with your use, or inability to use, the Website, any websites linked to it, any content on the Website or such other websites, including any direct, indirect, special, incidental, consequential, or punitive damages, including but not limited to, loss of revenue, loss of profits, loss of business or anticipated savings, loss of use, loss of goodwill, loss of data, and whether caused by tort (including negligence), breach of contract, or otherwise, even if foreseeable.

7. Indemnification

You agree to defend, indemnify, and hold harmless CMBM Holdings, its related entities, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Website.

8. General Provisions

8.1 Severability

If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.

8.2 Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Victoria, Australia. In the event of any dispute arising out of or relating to these Terms or the Website, the parties agree to first attempt to resolve the dispute informally by contacting us. If the dispute cannot be resolved informally within 30 days, the parties agree to engage in mediation through an agreed mediator in Victoria. If mediation fails, any legal suit, action, or proceeding shall be instituted exclusively in the federal or state courts located in Victoria, Australia.

8.3 Changes to the Terms

We may revise and update these Terms from time to time in our sole discretion. For material changes, we will provide at least 14 days' notice by posting a prominent notice on the Website or sending an email to registered users. All other changes are effective immediately when we post them. Your continued use of the Website following the posting of revised Terms means that you accept and agree to the changes.
